Terms and Conditions for HabitsCharity

Welcome to HabitsCharity!

These Terms of Service ("Terms") govern your use of the HabitsCharity habit tracking application and website at https://habitscharity.top ("Service"). By using our Service, you agree to these Terms.

1. Description of HabitsCharity

HabitsCharity is a habit tracking application that uses financial accountability and charitable giving to help users build better habits. When you set a stake on a habit and miss completing it by your deadline, your stake is automatically donated to a verified 501(c)(3) nonprofit organization of your choice.

2. Acceptance of Terms

By creating an account and using HabitsCharity, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

3. Eligibility

You must be at least 13 years old to use HabitsCharity. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use HabitsCharity, you must create an account using:
- Google OAuth authentication, or
- Email and password authentication

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. How the Service Works

5.1 Creating Habits
You can create habits by specifying:
- Habit name and emoji
- Daily deadline for completion
- Stake amount ($1-$100)
- Selected charity from our verified catalog

5.2 Wallet System
You must fund your HabitsCharity wallet to activate habits with stakes. Wallet funding is processed securely through Stripe using credit card, debit card, Apple Pay, or Google Pay.

5.3 Completing Habits
To complete a habit, you must mark it as complete in the app before your specified deadline. If you complete your habit on time, your stake remains in your wallet.

5.4 Missed Habits and Automatic Donations
If you do not mark a habit as complete by the deadline, your stake will be automatically deducted from your wallet at midnight and donated to your selected charity. This process is automatic and cannot be reversed once the deadline passes.

5.5 Charitable Donations
All charitable donations are made to verified 501(c)(3) nonprofit organizations. HabitsCharity retains a 4% platform fee from each donation to cover operational costs. The remaining 96% goes directly to the charity.

6. Fees and Payments

6.1 Service Fee
The app is free to use. Our only revenue is a 4% platform fee on donations made when habits are missed.

6.2 Payment Processing
All payments are processed through Stripe. You agree to Stripe's Terms of Service and acknowledge that HabitsCharity does not store your full payment card details.

6.3 Wallet Refunds
Funds in your wallet can be withdrawn at any time, subject to a processing period of 5-10 business days. Refund requests can be made by contacting us at bartzalewskidev@gmail.com. Donations that have already been made to charities cannot be refunded.

6.4 Disputed Donations
Once a habit deadline passes and a donation is processed, it cannot be reversed. Please ensure you mark habits as complete before the deadline. We do not provide refunds for donations resulting from missed deadlines.

7. User Obligations

You agree to:
- Provide accurate information when creating your account
- Maintain sufficient funds in your wallet to cover your active habit stakes
- Mark habits as complete accurately and honestly
- Not abuse or manipulate the Service
- Comply with all applicable laws and regulations
- Not use the Service for any unlawful or fraudulent purpose

8. Prohibited Conduct

You may not:
- Create multiple accounts to abuse the system
- Use automated tools or bots to manipulate habit completion
- Attempt to circumvent the payment system
- Interfere with or disrupt the Service
- Use the Service to launder money or conduct fraudulent charitable donations
- Reverse engineer, decompile, or disassemble any part of the Service

9. Charitable Organization Selection

HabitsCharity provides a curated list of verified 501(c)(3) nonprofit organizations. We make reasonable efforts to ensure all listed charities are legitimate, but we do not guarantee the effectiveness or practices of any charitable organization. Users are encouraged to research charities independently.

10. Limitation of Liability

HabitsCharity is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

- We are not liable for any missed habits, incorrect donations, or technical failures
- We are not responsible for the actions or practices of charitable organizations
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid in platform fees in the 12 months prior to the claim

11. Service Modifications and Termination

We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Change pricing, features, or terms with reasonable notice
- Terminate or suspend accounts that violate these Terms

If we discontinue the Service, we will provide reasonable notice and refund any remaining wallet balance.

12. Intellectual Property

All content, features, and functionality of HabitsCharity, including but not limited to text, graphics, logos, and software, are the property of HabitsCharity and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

13. Data and Privacy

We collect and store user data including name, email, payment information, habit tracking data, and donation history as necessary to provide our services. For complete details on how we handle your data, please refer to our Privacy Policy at https://habitscharity.top/privacy-policy.

14. Dispute Resolution

14.1 Informal Resolution
If you have a dispute with HabitsCharity, please contact us at bartzalewskidev@gmail.com and we will attempt to resolve it informally.

14.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14.3 Arbitration
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

15. Indemnification

You agree to indemnify and hold harmless HabitsCharity, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any fraudulent or illegal activity

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Updates to the Terms

We may update these Terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. Any updates will be posted on this page with an updated "Last Updated" date. We will notify users via email about significant changes. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

19. Entire Agreement
